This Privacy Policy applies to any website, application, feature, widget orother online service that is owned or controlled by Premium Brands Opco LLC, its subsidiaries and affiliated companies (i.e., companies affiliated with the Ann Taylor, LOFT and Lou & Grey brands, collectively "Premium Brands," "we," or "us"), that posts a link to this Privacy Policy (collectively, the "Channels"), and by Premium Brands offline. By using the Channels, you acknowledge the terms of our privacy policy in effect at the time of yourvisit.

By doing business with or interacting with the Channels in the mannerdescribed in this Privacy Policy at any time after the last updated date notedabove, you are accepting the practices described in this Privacy Policy andyou expressly consent to the application of this Privacy Policy to thecollection, storage, use and disclosure of your personal information asdescribed. We collect information from you and about you in order to provide you with theproducts you request, to improve and personalize our interactions with you,including through the Channels, and to more effectively market our products.The information we collect includes "Personal Information" as thatterm is defined under applicable laws. Personal Information includesinformation that identifies you as a specific, identified individual, such asyour name and address. We will also treat additional information, including IPaddresses and cookie identifiers, as "personal information" whererequired by applicable law. For example, we may collect:

Contact Information, such as name, address, email address, and shipping andbilling addresses
Transaction-related information, such as what items you purchased orreceived, the total prices you paid, cancellation, return, and exchangeinformation, products or services considered, and your participation in asweepstakes or contest
Payment information, such as credit or debit card number and expiration date
User Account information, such as a username, password, and account settings
Demographic information, such as age, date of birth, marital status, sexand/or gender, income level, level of education, occupation or field
Photo/Video Data or other user generated content, such as videos capturedthrough our in-store security cameras, and any photos, audio or videorecordings you choose to share in connection with product reviews, surveyresponses, live chat or other customer service interactions, or posts in ourcommunity forum
Device ID information, such as IP address, mobile device ID, device modeland operating system, mobile network information, approximate locationinformation, the site or advertisem*nt that referred you to our Channels,navigation patterns on the Channels, and the next site you visit afterleaving the Channels

Information You Provide

You may provide your personal information to us directly when you:

Place an order for a product through one of our Channels
Register for an account, sign up for style appointments or personal stylistservices, create wish lists, or sign up for catalogs, email alerts, or textmessages
Respond to surveys, submit reviews, enter contests or drawings, or registerfor and participate in loyalty programs
Contact customer service or other points of contact to submit questions orrequests
Submit information to us through interactive features, social mediaplatforms, or other communication functionality

Information That is Collected Automatically

We may collect information automatically when you visit and use our Channels("Device ID / Interaction Information"). For example, weautomatically collect your information when you open or respond to our emails,contact customer service or use support tools, visit any page that displaysour ads or content, connect or link to any Channel via social networkingsites, post comments to online communities or provide information to ourservice providers, including our advertising and business partners. Thefollowing are examples of how we automatically collect information through theSites:

Browsing and Device Information: We automatically collectsome information and data about your computer and mobile devices when youvisit our Channels. For example, we will collect your IP address, web browsersoftware, and information about referring websites. We also may collectinformation about your online activity, such as merchandise viewed andpurchases made, as well as general location data that helps us to tailor theversion of the Channel that you see in order to enhance your shoppingexperience.

Cookies: Cookies are small data files stored on yourcomputer’s web browser. These technologies can store a unique identifierfor a device to allow a certain Internet site to recognize the device wheneverthe devise is used to visit the site. These technologies may be used for manypurposes by us and our third-party service providers, such as automaticallycollecting Device ID / Interaction Information, enabling features, rememberingyour preferences, and providing you with targeted advertising elsewhereonline. If you do not want to accept cookies, you can block them by adjustingthe settings on your Internet browser, however, some features of the websitemay not function if you block all cookies. You may also elect to limitthe use of cookies in connection with targeted advertising, as described inthe Third Party Advertising and Analytics section below.

Pixel Tags:We use 'pixel tags' (small graphic imagesalso called web beacons or clear gifs) or similar technologies to trackinformation in the aggregate about your use of the Sites like the web pagesyou view, the links you click, and the time you spend on a page. We use thisinformation to monitor the effectiveness of our advertising and marketingcampaigns so we can learn how to best deliver your customer experience. Wealso use pixels to track our email campaigns to determine whether recipientsopened the email and what links they clicked on from the email.

Embedded Scripts: An embedded script is programmingcode that is designed to collect information about your interactions with theSites, such as the links you click on. The code is temporarily downloaded ontoyour device from our server or a third-party service provider, is active onlywhile you are connected to a Site, and is deactivated or deletedthereafter.

Analytics tools and aggregate data:The Sites useanalytics tools, such as Google Analytics and Adobe Analytics, web analyticsservices provided by Google, Inc. and Adobe, Inc., respectively. GoogleAnalytics and Adobe Analytics use cookies to help the Sites analyze how youuse the Sites. The information generated by the cookie about your use of theSites (including your IP address) will be transmitted to and stored by Googleand Adobe, respectively, in aggregate form. Google and Adobe may use thisaggregated information in order to evaluate use of the sites, compile reportson Sites activity and other services relating to Sites activity and usage. Session Replay Tool: We use session replay technology to helpus reconstruct the user experience on our Channels. We use this technology totroubleshoot issues with and improve user experience on our sites. The toolprovides insight into what works and what doesn’t work for users of thesites, and it allows us to, for example, identify and repair technical errors,such as broken links that impair the Sites’ functionality. We may alsouse the tool to authenticate users, enable Sites features, prevent fraud, andimplement security measures. The tool uses cookies and similar technologies tocollect and analyze information related to user behavior on our sites, such asmouse movements, clicks, user inputs, scrolling, access times, visit duration,pages viewed, IP address (including location), operating system, pagereloading, crash data, performance data, and other diagnostic data. The toolalso collects name, email address, phone number, and physical address if youenter this data during a session. The Service Provider we utilize for sessionreplay is prohibited by contract from using data collected using this featurefor any other purpose, or from selling or sharing any data collected by ususing the session replay tool.

Chat Technology: Our Channels use a chat feature to respondto customer inquiries. These chat features collect personal information,including but not limited to email address and the content of the chatcommunications, on our behalf. Conversations conducted via the chat featureare recorded, and you should not continue with chat assistance if you do notconsent to recording. Recorded chat sessions are used by us internally and arenot sold, shared, or used for purposes of targeted advertising.

Information Collected from Third Parties

We may also collect your personal information from third parties, including:

Third Party Platforms: If you connect or interact with us onthird-party sites or applications, such as social media platforms, thethird-party platform may send us your information, such as your profileinformation from that platform. The information collected and disclosed to usis controlled by the third-party platform and its terms and privacy policy oras you direct by adjusting your privacy settings on the third-party platform.

Send-to-a-Friend Features: We may make available on theChannels a "send-to-a-friend," "refer a friend,""wish list" or similar function that permits you to send Channelcontent directly to a third-party through the Channels. If you send a friend acommunication using such functionality, the information you provideabout your friend (e.g., name and email address) is used to facilitatethe communication and is not used for any other marketing purpose unless weobtain consent from that person. If you disclose any personal data relating toother people, you represent that you have the authority to do so and to permitus to use the data in accordance with this Privacy Policy.

Data brokers: We may obtain information about customers orpotential customers from third party sources, such as data brokers or addressverification vendors for purposes of fulfilling your orders or requests,better understanding and analyzing our business and your experience, and tomore effectively market our products to customers.

We may use your personal information to accomplish our business purposes,including to:

Complete your transaction, process and ship your order, or respond to yourquestions or requests
Personalize your experience, store your preferences, provide user-experiencefeatures, and to operate our business and provide our products and services
Administer our business (e.g.,to make improvements to thesites, conduct analytics, and enhance our products and services)
Facilitate your participation in our loyalty programs, personal styleservices, and other customer offerings
Allow you to create and maintain wish lists and other information in youraccount
Communicate with you, including by electronic means, about your order,special offers, promotions, and other products or services we think may beof interest to you
Create and administer contests, drawings, special events, and surveys
Enhance and customize your customer experience and customer service in ourstores, call centers, and on the Sites

When appropriate, we may share your information with:

Affiliated Brands, Including for Direct Marketing: We mayshare your information with our family of companies, including companiesassociated with the LOFT, Ann Taylor and Lou & Grey brands, which like Premium Brands are also owned, directly orindirectly, by the same parent companies for business, analytical, andoperational purposes. We also share personal data with these affiliatedcompanies so that they may contact you with their own direct marketing. Youmay opt out of our sharing personal data we have collected about you withAffiliated Brands for their direct marketing purposes as described in the Updating Your Personal Data section below.

Service Providers:We engage with select service providers whoprovide services to support our operations, such as: order processing andfulfillment, market research, advertising and promotion of products, managingpromotions and contests, websites analytics, and other support services. Suchparties may, from time to time, have access to your information to enable themto provide the services. Service Providers are prohibited from selling orsharing your information, or from using your information for purposes beyondthe scope of the services they are providing on our behalf.

Third Party Marketing Services:We may use third-party serviceproviders to perform certain services on our behalf, such as hosting theChannels or Channel features, delivering packages, processing credit cardpayments, processing transactions and fulfilling orders, removing repetitiveinformation from customer lists, providing customer service, providing websiteusage analytics, providing search results and links (including paid listingsand links), providing targeted advertising, sending email, direct mail orother communications, providing marketing assistance and data analysis orenhancement, or performing other administrative services. We may give theseservice providers access to your information (or allow them to collectinformation from or about you) so that they can carry out the services theyare performing for you or for Premium Brands.

Additionally, we may share various information relating to our users andfraudulent or potentially fraudulent activities with our fraud prevention andsimilar service providers, and they will use this information to help us andtheir other clients prevent fraudulent and illegal transactions.

One company with whom we may work is Borderfree, a U.S.-based service providerthat we may contract with to facilitate the sale and fulfillment ofinternational online purchases. Where Borderfree will be used to fulfill yourinternational purchase, information that you provide during the checkoutprocess will be collected by or provided to Borderfree and will be processedin accordance with Borderfree’s own privacy policy found at:https://www.borderfree.com/privacy/en_us/. By making such a purchase, youagree to Borderfree’s Privacy Policy and Terms & Conditions of Use.

Unaffiliated Third Parties for Direct Marketing: We may sharepersonal data with unaffiliated third parties for their own direct marketingand other purposes. You may opt out of our sharing personal data we havecollected about you with unaffiliated third parties for their direct marketingpurposes as described in the Updating Your Personal Data section below.

Other Third Parties: As further described in theHOW WE USE INFORMATION sectionabove, we may share your information to protect your safety or the safety ofothers when we have reason to believe that disclosing the information isnecessary to identify, contact or bring legal action against someone who maybe causing injury to you, our employees or otherwise injuring or interferingwith our rights, property or operations, other customers, or anyone else whocould be harmed by such activities; to comply with legal obligations, such aswhen required by law, or in response to any demand by law enforcementauthorities in connection with a criminal investigation, or civil oradministrative authorities in connection with a pending civil case oradministrative investigation; and to maintain the security of the Channels andservices and to resolve or troubleshoot technical issues.

When you agree to receive information from third parties or request that weshare your information: We will disclose your information to a third party (or parties) when youdirect us to do so or you consent to the sharing, and your information willthen be subject to the privacy policy and practices of that third party. Forexample, you may be presented with an opportunity to receive information ormarketing offers from one or more third parties or to use an interactivefeature or third-party application.

Cobranded Credit Card: When you apply for and use a brandedcredit card, Premium Brands may share certain data at your direction tofacilitate your application and use of the card. In addition, Premium Brandsmay share data with the issuing bank for our Ann Taylor or LOFT credit card, and its affiliates, for purposes related to those credit cards. Forexample, we may share information to send joint offerings, includinginformation on how to apply for an Ann Taylor or LOFT credit card, and inconnection with your use of an Ann Taylor or LOFT credit card, such as tomaintain or service accounts and to effectuate transactions. We may also sharedata with these parties for analytics purposes.

Business transfers and transitions: We reserve the right tosell, rent, disclose, or transfer your personal information to a successorentity in the event of a corporate merger, consolidation, sale of assets,bankruptcy, or other corporate changes respecting us or our affiliatedcompanies.

We may work with network advertisers, ad agencies, analytics serviceproviders, and other vendors to serve our advertisem*nts on our Channels andthird-party websites, apps, and elsewhere online, to provide us with dataregarding use of and traffic on the Channels (including without limitation thepages viewed and the actions users take when visiting the Channels), and theeffectiveness of our advertisem*nts. For example, if you click on anadvertisem*nt for Premium Brands, our service provider(s) may be able to tellus the advertisem*nt you clicked on and where you were viewing theadvertisem*nt. The advertisem*nts you see may be served by us or one or morethird parties, who may use data about your activities on the Channels, andother websites and services you visit across the various devices you use, toprovide you targeted content and advertising. Our service providers maycollect certain data about your visits to and activity on the Channels andother websites and services and may use this data to target advertising toyou.

These third parties may set and access their own tracking technologies on yourdevice (including without limitation cookies and web beacons) and mayotherwise collect or have access to information about you (such as DeviceID/Interaction Information). Some of these parties may collect personal dataover time when you visit the Channels or other online websites and services.Cookies and web beacons, including without limitation those set by third-partynetwork advertisers, may be used to (among other things): targetadvertisem*nts, prevent you from seeing the same advertisem*nts too manytimes, and conduct research regarding the usefulness of certain advertisem*ntsto you. We may share certain data, such as device identifiers, DeviceID/Interaction Information, hashed information, records of transactions youconduct on our Channels or offline, and other types of de-identified orpseudonymized data with third-party advertising companies, analyticsproviders, and other vendors for advertising and analytics purposes. Inaddition, we and our third-party service providers may use this data toperform matching with third-party cookies to provide targeted onlinemarketing. If you would like to opt-out of third-party advertising andanalytics, there are a variety of tools available to you:

Cookie Opt-Out Tools: To disable sharing through cookiesset on our site by third parties for advertising and analytics purposes,please adjust your settings by using our Cookie Management Tool. Residents of some states have additional rights to opt-out of the sharing or processing of their personalinformation for purposes of targeted advertising, as described in the Jurisdiction-Specific Rights section below.

Do Not Track / Global Privacy Control: Do Not Track ("DNT")signals offered by some web browsers are settings that request that a webapplication disable its tracking of an individual user. When you choose toturn on the DNT setting in your browser, your browser sends a special signalto websites, analytics companies, ad networks, plug in providers, and/orother web services you encounter while browsing to stop tracking youractivity. Global Privacy Control ("GPC") is a technical specification inyour browser settings that you can use to automatically inform websites ofyour privacy preferences with regard to third party online tracking. NAI/DAA Opt-Out:Some of the companies we use may bemembers of the Network Advertising Initiative ("NAI") or Digital AdvertisingAlliance ("DAA"). The NAI provides information regarding targetedadvertising and theopt-out procedures of NAI members, including opt-out mechanisms for web browsers, mobile and other connecteddevices, and a tool to opt out from participating NAI members using yourhashed email address for interest-based advertising. You may also want tovisit theDAA's website, which provides information regarding targeted advertising and offers anopt-out for DAA-participating companies.

Google Analytics: We use Google Analytics, which usecookies and similar technologies to collect and analyze information aboutthe use of the Channels and report on activities and trends. This servicemay also collect information about the use of other websites, apps, andonline services. You canlearn about Google's practices, and opt out of them by downloading theGoogle Analytics opt-out browser add-on.

Please note that opting out through these mechanisms does not opt you out ofbeing served advertising, and that you will continue to receive generic adswhile online. Text Messages from our Stores:While shopping with us,an associate may give you the option to opt-in to receive text messages fromyour local store about new product information, style appointments,promotional events, and transactional information on the mobile phonenumber(s) you have shared with us. We will not contact you via text messagesfor marketing purposes without your prior consent. You do not have to opt-into text messages to make purchases from us. Updating Your Personal Data: The Channels may containwebpages or applications through which you can correct or update some of thepersonal data you have provided (such as via an online account) or throughwhich you may be able to unsubscribe or modify the email newsletters orsimilar communications we send to you. If you have an online account, youare responsible for maintaining and updating, as applicable, your accountregistration data with current, accurate, and complete information. We may provide links on the Channels to third-party websites we think may beof interest to you, including plugins that link to social media sites, such asFacebook, Pinterest, and Instagram. These websites are independent fromPremium Brands and have their own separate privacy policies. We are notresponsible for the privacy practices or content of such third-party websitesand embedded applications. Whenever you click on links on the Sites that takeyou to a third-party website or embedded application, you will be subject tothe third-party’s privacy policies. We recommend that you review thethird-party’s privacy policies before you visit these websites andembedded applications.

Our Channels are intended for a general audience and are not intended for useby or targeted to children younger than the age of 18. We do not knowinglycollect personal data from children younger than the age of 18. If you are theparent or legal guardian of a child younger than age 18 and believe that wehave inadvertently collected personal data from your child, please contact ususing the information in theContact Us section below.

Premium Brands is a United States company. Please be aware that data wecollect will be transferred to and processed in the United States and othercountries. By using the Channels or providing us with any information, youfully understand and unambiguously consent to this transfer, processing, andstorage of your data in the United States and other jurisdictions, for whichthe privacy laws may not be as comprehensive as those in the country where youreside and/or are a citizen. As a result, this data may be subject to accessrequests from governments, courts, or law enforcement in the United States andother countries according to laws in those jurisdictions.

Residents of California, Colorado, Connecticut, Montana, Oregon, Texas, Utah,and Virginia have certain privacy rights under state law. The below sectiondescribes these data rights and how residents of these states can exercisethem.

The Personal Information we collect about you will depend upon how you use ourSites or otherwise interact with us.
